What are Immigration Evaluations?

An immigration evaluation is a mental health assessment conducted by a licensed professional to support an individual’s immigration case in the U.S. or other countries. These evaluations are not about determining immigration status but instead focus on how an immigration-related issue affects a person's psychological or emotional well-being.

 

The goal is to provide a professional, clinical perspective that can strengthen an immigration petition. The evaluation results in a detailed written report submitted to immigration attorneys and ultimately to immigration authorities.

Types of Immigration Evaluations Offered

  • Cancellation of Removal

Hardship Waiver -Immigration Evaluation

HARDSHIP WAIVER

Assesses the emotional, psychological, or medical hardship a U.S. citizen or legal resident would suffer if their relative were deported or denied residency.

Cancellation of Removal - Immigration Evaluation

CANCELLATION OF REMOVAL

Shows the hardship that deportation would cause to a U.S. citizen family member, often a child or spouse.

Asylum - Immigration Evaluation

ASYLUM

Evaluates the psychological effects of persecution, trauma, or fear of returning to one’s home country.

VAWA (VIOLENCE AGAINST WOMEN ACT*)

VAWA (VIOLENCE AGAINST WOMEN ACT*)

Evaluates the psychological effects of domestic violence on a spouse or child of a U.S. citizen or permanent resident.

*Applicable to all genders

U-VISA - Immigration Evaluation

U-VISA

For victims of a crime. Evaluates the mental and emotional impact (symptoms may have an onset or have worsened) of a crime on the victim, for crimes committed in the US.

T-VISA - Immigration Evaluation

T-VISA

For victims of human trafficking. Evaluates the psychological trauma experienced and its ongoing effects.

Immigration Evaluations for Children

Here are some examples of when an immigration evaluation may be needed for a child:
 

  • Hardship Waivers: evaluates how a child would suffer if a parent or guardian were deported

  • Unaccompanied Minors seeking asylum

  • U Visa: when a child is a victim of a crime like abuse or domestic violence

  • T Visa: when a child was trafficked, especially common among children exploited for labor or sex work

  • VAWA: for children abused by a U.S. citizen or permanent resident parent
